Terms of Service

These Terms govern your use of the Face Analyzer website and services ("Service"), provided by Rubin Beld, a sole trader established in the Netherlands, operating the website faceanylzer.com(referred to in these Terms as "Face Analyzer", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The seller

You are contracting with Rubin Beld, a sole trader established in the Netherlands, trading as "Face Analyzer" via faceanylzer.com. Contact: support@faceanylzer.com.

2. The Service

Face Analyzer provides AI-assisted facial analysis from images you upload, with optional paid plans unlocking additional features, quotas, and exports. You must be of legal age in your jurisdiction (or have authority to bind your organisation) to use the Service.

You must provide accurate registration information, keep it up to date, and keep your credentials confidential. You are responsible for activity under your account.

The Service uses machine-learning models. Outputs may be inaccurate, incomplete, or unsuitable for any particular purpose, and are not medical, psychological, dermatological, or other professional advice. You are responsible for how you use any output. We may filter, restrict, or refuse outputs that violate these Terms or our safety policies.

6. Your content and licence

You retain ownership of images you upload. You grant us a limited, non-exclusive licence to host, process, and transmit your content solely to provide and improve the Service. We may remove content that violates these Terms. Repeated infringement may lead to account termination. To report infringement, email support@faceanylzer.com.

7. Intellectual property

The Service, including software, models, design, and branding, is owned by Rubin Beld or our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your plan.

8. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations, and refunds are governed by Paddle's Checkout Buyer Termsand Refund Policy, together with our Refund Policy.

Subscription plans renew automatically at the end of each billing period until cancelled. You can cancel at any time via your account or by contacting Paddle at paddle.net.

9. Service availability

We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We may perform maintenance, change features, or discontinue parts of the Service.

10. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends.

11. Warranties and liability

To the fullest extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Our aggregate liability for any claims arising from or related to the Service is limited to the fees you paid to us (via Paddle) in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot lawfully be excluded under Dutch or EU consumer-protection law.

12. Indemnity

You agree to indemnify us against claims arising from your content, your use of outputs, or your breach of these Terms.

13. Changes

We may update these Terms. Material changes will be notified via the Service or email. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws rules. Disputes will be submitted to the competent Dutch courts, subject to any mandatory consumer-protection rights you have under the laws of your country of residence.
